Rental Terms

All vehicle rentals with Swinton are governed by a comprehensive Rental Agreement that you will receive upon booking confirmation or at the time of vehicle pickup. This document outlines the specific terms, conditions, insurance information, fees, and your obligations related to the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.

Eligibility Criteria

Car Hire Rental Requirements

• To hire a vehicle from Swinton, you must be at least 21 years old, though age restrictions can vary based on the vehicle type. Drivers under 25 may incur additional charges. A valid driving licence, appropriate for the vehicle category and held for the duration outlined in the Rental Agreement, is required. You will need to present valid identification and proof of your current address, along with payment details and a security deposit. Additional criteria may be specified in the Rental Agreement.

Booking and Payment Process

• Reservations can be made via our website, over the phone, or directly at our Dartford office. A deposit may be necessary to confirm your booking. Full payment, along with a security deposit, is usually required at the time of vehicle pickup. All prices are quoted in British Pounds (£) and include VAT as applicable. We accept all major credit and debit cards, processed securely through trusted payment systems.

Vehicle Pickup and Drop-off

• At the time of vehicle collection, a thorough inspection is required to identify any pre-existing damage. Please report any findings immediately. A vehicle condition report will be completed and signed by both parties. It is expected that the vehicle is returned in the same condition as it was collected, taking into account normal wear and tear. Any new damage will be evaluated and costs applied as necessary. The vehicle should be returned with the same fuel level as at collection; otherwise, refueling charges will be incurred. If a late return is anticipated, please contact us right away, as additional fees may apply. You will be responsible for any parking fines, traffic violations, or fees incurred during the rental, along with an administrative charge.

5. Coverage and Responsibility

• All rentals include basic third-party insurance. You will find comprehensive coverage details and excess amounts outlined in your Rental Agreement. Additional insurance options may be offered to lower your financial liability. It is beneficial to assess these options thoroughly. You remain liable for any damage or loss up to the excess amount, unless additional insurance is purchased. Damage resulting from negligence, misuse, or violation of these Terms remains your responsibility, irrespective of existing insurance coverage.

6. Modifications and Cancellations

Cancellation and amendment policies differ based on the type of booking and the amount of notice provided. For precise information, please consult your booking confirmation or Rental Agreement. Late cancellations or failure to show up may incur additional charges.

Prohibited Activities

Prohibited Vehicle Uses

• Prohibited activities include any illegal use of the vehicle, such as racing, rallying, or off-roading, as well as engaging in hazardous activities. Transporting dangerous materials, sub-letting the vehicle, or allowing unauthorized drivers is not permitted. Driving under the influence of alcohol or drugs, exceeding passenger or weight limits, and operating the vehicle outside of agreed geographical boundaries without prior approval are also strictly forbidden.

Breach of these terms may lead to rental termination and extra fees.

Liability Limitations

To the fullest extent allowed by English and Welsh law, Swinton Car Hire will not be responsible for any indirect, incidental, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our total liability for any claims shall not exceed the rental amount you paid in the previous 12 months. This limitation does not affect our liability for death or personal injury due to negligence or fraud.

Governing Law Framework

These Terms are governed by the laws of England and Wales. Any disputes will fall under the exclusive jurisdiction of the courts in these regions.

10. Updates to Terms

We reserve the right to amend these Terms at any time. Changes take effect as soon as they are posted on our website. Your ongoing use of our services indicates your acceptance of the updated Terms.
