Rental Terms
All car rentals are governed by a comprehensive Rental Agreement, which you will receive upon booking confirmation or when collecting your vehicle. This document outlines specific terms, conditions, insurance coverage, fees, and your obligations related to the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Vehicle Rental Requirements
- To rent a vehicle from Swinton, you must be at least 21 years old, although age restrictions may vary depending on the vehicle type. Drivers under 25 may incur additional charges. A valid driving licence that meets the criteria outlined in the Rental Agreement is required, along with identification and proof of address. You will also need to provide valid payment information and a security deposit, as well as any other requirements specified in the Rental Agreement.
Booking and Payment Details
- Reservations for car hire can be made via our website, by phone, or in person at our Dartford office. A deposit may be necessary to confirm your booking. The balance and a security deposit are generally due upon vehicle pickup. All prices are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards, processed through trusted payment providers.
Vehicle Pickup and Drop-off
- At the time of collection, please conduct a thorough inspection of the vehicle and report any pre-existing damage without delay. We will complete a vehicle condition report for your records. It is your responsibility to return the vehicle in the same condition as it was received, taking into account standard wear and tear. Any new damage will be evaluated and may incur additional charges. Ensure that the vehicle is returned with the same fuel level as when collected; otherwise, refueling fees will apply. If you anticipate returning the vehicle late, contact us promptly, as late returns may result in extra charges. You will be responsible for any parking fines, traffic violations, or other charges that occur during your rental, along with an administration fee.
Insurance and Liability Terms
- All rentals include basic third-party insurance. The Rental Agreement outlines the specifics of this coverage and any applicable excess amounts. Additional insurance options may be available to limit your financial exposure. It is advisable to review these options closely. You remain liable for damage or loss up to the excess, except where additional insurance applies. Any damage resulting from negligence, misuse, or violation of these Terms remains your responsibility, irrespective of insurance coverage.
Cancellation and Modifications
Cancellation and amendment policies differ based on the type of booking and the notice period provided. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or failure to show up may incur additional charges.
Prohibited Activities
Prohibited Uses of Rental Vehicle
- The vehicle may not be used for any unlawful activities. This includes racing, rallying, off-road driving, or other dangerous pursuits. Transporting hazardous materials is prohibited. Sub-letting to third parties or permitting unauthorized drivers is not allowed. Driving under the influence of alcohol or drugs is strictly forbidden. The vehicle must be used only for its intended purpose and within specified passenger and weight limits. Driving outside designated geographical boundaries without prior approval is not permitted.
Breach of these terms may lead to rental cancellation and extra fees.
8. Liability Limits
To the fullest extent allowed by English and Welsh law, Swinton Car Hire will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business related to your use of our services. Our total liability for any claims is capped at the amount paid for the rental in the previous 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence or fraud.
9. Applicable Law
These Terms are regulated by the laws of England and Wales. Disputes will fall under the sole jurisdiction of the English and Welsh courts.
Updates to Terms
We reserve the right to update these Terms at any time. Changes take effect immediately upon posting on our website. Continued use of our services indicates your acceptance of the revised Terms.
